Truck Driver With History of DUI Reaches Plea Deal in Three-Vehicle Crossover Crash
Pocatello, ID – A truck driver with a history of driving under the influence (DUI) has reached a plea agreement with prosecutors stemming from charges filed following a three-vehicle crossover crash earlier this year.
Shane Warr, 58, of Blackfoot, ID, agreed to plea guilty to aggravated DUI (a felony), in exchange for the Bannock County Prosecutors Office dropping misdemeanor charges of possessing an open container of alcohol while driving and possession of a concealed firearm while intoxicated.
Warr originally entered a not-guilty plea on all charges but changed his plea regarding the aggravated DUI charge on August 2, according to court documents.
He now faces up to 15 years in prison.
The charges stem from a crossover crash in Pocatello, ID along Interstate 15 on February 3.
Idaho State Police (ISP) investigators said Warr was operating north in a Freightliner tractor pulling a trailer loaded with alcohol when he crossed over the median and into the southbound lanes.
Warr collided with a 2015 Chevrolet Suburban, driven by Debbie Akers, 54, and a 2020 Ford Ranger, driven by Clay Hirschi, 23, both of Pocatello, ISP said.
Akers suffered non-life threatening injuries and was transported to a nearby hospital for treatment.
However, a lawsuit since filed by Akers against Warr and his former employer, EC Distribution of Idaho, LLC, describes her injuries as “severe and permanent.”
Following the accident, Warr submitted to two breathalyzer tests conducted by ISP at the scene.
The first test returned a breath alcohol concentration (BAC) of 0.132 and the second 0.124.
Per Federal Motor Carrier Safety Regulations it is illegal to operate a commercial vehicle requiring a CDL with greater than 0.04 BAC.
Further, ISP also discovered a weapon in Warr’s truck leading to an additional charge of carrying a concealed weapon while under the influence.
Warr reportedly has a long history of alcohol abuse dating back at least two decades.
In August 2016, he was convicted in Idaho for an alcohol DUI and had his license suspended for one year.
Earlier this year, following his latest accident, the Federal Motor Carrier Safety Administration (FMCSA) deemed Warr an “imminent hazard” and banned him from operating a commercial motor vehicle until he successfully completes the statutorily required return-to-duty process overseen by a substance abuse professional.
Warr is scheduled to be sentenced on October 12.
